OFFICIAL RULES NO PURCHASE NECESSARY TO ENTER THE PROMOTION. 1) Promotion Timing: The Prilosec OTC Get Tough on Holiday Heartburn Challenge Promotion (the "Promotion") begins 4:00 p.m. ET on 10/31/2008 and ends 11:59 p.m. ET on 1/4/2009 (the "Promotion Period"). You may register for the Promotion beginning 4:00 p.m. ET on 10/31/2008 through 11:59 p.m. ET on 12/22/2008 (the "Registration Period"). Sponsor's clock is the Official Time Keeper of the Promotion. See Rule #3 for complete details on how to register for the Promotion. 2) Eligibility: The Promotion is open only to legal residents of the 50 United States, including the District of Columbia, who are 18 years of age or older as of date of entry. Employees of The Procter & Gamble Distributing LLC (the "Sponsor"), the NFL Entities (as defined below), its parents, subsidiaries, divisions, affiliates, suppliers, distributors, advertising, promotional and judging agencies, including Don Jagoda Associates, Inc. (the "Administrator") and their immediate family members (spouses, parents, children, and siblings and their spouses) and household members of each (whether related or not), are not eligible to participate or win. All federal, state and local laws and regulations apply. 3) How To Participate in the Promotion: There is no purchase necessary to participate in the Promotion. A purchase does not increase your chances of winning. During the Registration Period, visit www.gettoughonheartburn.com (the "Promotion Website") and register for the Promotion by completing all required information requested on the online form. Participants must provide his/her residential address on the online form. Commercial Addresses may not be used. Limit one registration per person and per household. You must read the Procter & Gamble Privacy Policy at http://www.pg.com/privacy/english/privacy_notice.html. a) To Receive $25 Redeemable at NFLShop.com ("Gift Certificate"): There are 2,000 Gift Certificates available during the Promotion Period. The first 2,000 registered participants who successfully complete the challenge will receive a Gift Certificate. To complete the challenge, registered participants are required to answer one (1) daily trivia question provided on the Promotion Website for fourteen (14) consecutive days (the "Challenge"). Participants must answer the trivia question by selecting one of four multiple-choice answers. Participants who miss one or more of the 14 consecutive days will not be considered successful in completing the Challenge. Answers do not need to be correct. If the participant has purchased Prilosec OTC, they will be asked to provide a valid Package Code, which is located inside boxes of Prilosec OTC. There is no purchase necessary. A valid package code is not required to receive the Gift Certificate. The first 2,000 registered participants who have successfully completed the Challenge will receive the Gift Certificate within four weeks from the registration date. Limit one Gift Certificate per person per household. The Gift Certificate portion of the Promotion will conclude after the 2,000th registered participant completes the Challenge. All Participants, regardless if they were one of the first 2,000 Participants who successfully completed the Challenge or if they were not successful at completing the Challenge, will receive a 10% discount off a future purchase at NFLShop.com. b) To Enter the Grand Prize Drawing: Participants will receive one Grand Prize entry in the Promotion by registering, as indicated above. To receive additional Grand Prize entries in the Promotion, registered participants must log-in using the e-mail address provided during registration and answer that day's trivia question by selecting one of four multiple-choice answers. Answers do not need to be correct. Registered Participants may then return to the Promotion Website for the next 13 consecutive days, where they will be asked to log in and answer that day's trivia question. Participants will receive one entry for every day they log in and answer that day's trivia question. Limit fifteen (15) Grand Prize entries per person and per household during the Promotion Period. Participants who fail to complete the Challenge may still visit the website to receive additional Grand Prize entries into the Promotion. Any attempt by any entrant to obtain more than the stated number of entries/Gift Certificates by using multiple/different email addresses or mailing addresses, identities, registrations and logins, or any other methods will void that entrant's submission/entry and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. Normal Internet access and usage charges imposed by your on-line service will apply. The final day of the Challenge is dependant on your initial date of registration. Challenge officially ends 11:59 p.m. ET on 1/4/2009. 4) Grand Prize Random Drawing: One Grand Prize winner will be selected in a random drawing from among all eligible Grand Prize entries received. Drawing will be conducted on or about 1/5/2009, by Don Jagoda Associates, Inc., an independent judging organization whose decisions are final and binding on all matters relating to the Promotion. Odds of winning are dependent upon the number of eligible Grand Prize entries received. 5) Prize and Approximate Retail Value ("ARV"): (1) Grand Prize: Four tickets to attend Super Bowl XLIII at Raymond James Stadium on 2/1/2009 plus $8,000 awarded in the form of a check. (ARV: $8,800). Transportation to/from game is not included and is winner's responsibility. Prize is nontransferable and no cash substitution is allowed except by the Sponsor, who reserves the right to award a prize of equal or greater value if advertised prize (or portion of prize) is unavailable for any reason. Taxes, as applicable, related to the prize are the sole responsibility of winner. All other expenses and costs not expressly listed above are the winner's sole responsibility. 6) Winner Notification: The Administrator will make three (3) attempts to contact the potential Grand Prize Winner via phone and/or e-mail within 24 hours from the time winner selection is accomplished. If Administrator is unable to reach the potential Grand Prize Winner via phone within this time frame, he/she will be disqualified and an alternate will be selected. Potential Grand Prize Winner will then be required to sign and return an Affidavit of Eligibility, Release of Liability/Publicity Release (except where prohibited by law) within three (3) days of notification attempt or the Grand Prize will be forfeited and alternate winner may be selected. Affidavit package will be mailed via overnight mail with a pre-paid overnight return envelope included or sent via email. Return of prize or prize notification as undeliverable may result in disqualification and determination (based on the same judging criteria stated in rule 4) of alternate potential Grand Prize winner at Sponsor's sole discretion. A 1099 tax statement will be filed with the IRS for the Grand Prize winner. 7) General Rules: By participating in the Promotion, entrants agree to be bound by these Official Rules and the decisions of the judges. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Promotion materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control. Participating in the Promotion constitutes permission to the Sponsor and its agencies and designees to use Participants' names, biographical information, pictures/portraits or likenesses for purposes of advertising and trade without further compensation or limitation, unless prohibited by law. The Sponsor, the NFL Entities (as defined below), its Agencies and Administrators are not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in the Promotion or by any human error which may occur in the processing of the entries/submissions in the Promotion or for any liability for damage to any computer system resulting from participation in, accessing or downloading information in connection with the Promotion. In the event of a dispute as to any registration/entry, the authorized account holder of the email address used to register will be deemed to be the registrant/entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder of the email address associated with the registration/entry. Proof of entering information via the Promotion Website does not constitute proof of delivery or receipt of such information. Sponsor and/or its Administrator (as identified in these Official Rules) is not responsible for the failure of any email or entry to be received by Sponsor/Administrator on account of technical problems or congestion on the internet or at any website. The Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Promotion or Promotion Website; violates the Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If, for any reason, the Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, then the Sponsor reserves the right at its sole discretion to end the Promotion and determine the winners from among all eligible entries received prior to cancellation, or cancel the Promotion in its entirety. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure. By participating in the Promotion, the entrant agrees that Sponsor, its respective parents, subsidiaries, affiliated companies, agents, retailers, advertising and promotion agencies, and all of their respective shareholders, officers, directors, employees and assigns, members, representatives and agents, will have no liability whatsoever for, and will be held harmless by entrant for any liability for any bodily injury, loss, cost or damages of any kind to persons, including death and property, damages sustained due in whole or in part, directly or indirectly, from entry creation, the acceptance, possession, use or misuse of the prize or parts thereof, if applicable or participation in the Promotion or participation in any Promotion or related activity. Sponsor shall not be responsible nor liable for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by the air carriers, hotels or others providing services or accommodations, including loss or damage to baggage. By entering the Promotion, you hereby represent and warrant that you have read these Official Rules and are fully familiar with its contents. The Promotion and the Official Rules shall be exclusively governed by and construed in accordance with the laws of the state of New York, without regard to conflicts of law provisions.
